Privacy Policy for UpTakes Video Camera (“UpTakes”)

UpTakes is a patented gesture-controlled video camera app made by Uptakes Video LLC. We built this with privacy as a core design principle: your videos never leave your device, your motion data is processed entirely on-device, and we collect the minimum data needed to keep the app working and improving.

This policy explains what we collect, why, and your rights regarding that data.


1. What We Collect

1.1 Your Videos and Photos — We Don’t Touch Them

UpTakes accesses your device’s camera, microphone, and photo library only to record new video clips and save them to your device’s Photos. We do not upload, view, copy, scan, or store your videos on any server. We have no way to access existing media on your device. Recordings are stored entirely locally and remain under your control.

1.2 Motion Sensor Data

UpTakes uses your device’s accelerometer and gyroscope to detect when you raise the phone to record and lower it to stop. This processing happens entirely on your device. Motion data is never transmitted, stored, or shared.

1.3 App Usage Data

To keep the app working well and to fix problems, UpTakes records anonymous usage events on your device. These include things like:

  • Recording started, recording finalized, clip kept, clip deleted
  • Settings opened, gesture mode toggled, orientation changed
  • Trial state transitions (trial started, expired, etc.)
  • Subscription events (purchase completed, restored, verified)
  • Thermal state changes and device performance signals
  • Error and crash information

This data lives on your device by default. It only leaves your device when you choose to send it to us — for example, by tapping “Email UpTakes” or “Send Debug Log” in Settings. When you do, the data we receive is included in the email you sent.

1.4 Device Information We Receive in Support Emails

When you send a support email through the app, we receive a diagnostic snapshot containing:

  • App version and platform (iOS or Android)
  • Device model and operating system version
  • Free disk space and free RAM (rough numbers, used for diagnosing performance issues)
  • Subscription state (trial, active, expired)
  • Permission status (camera/microphone granted or denied)
  • Recent app activity (recording counts, settings changes)
  • A randomly generated Support ID we use to match logs to specific devices

We do not receive your name, email address (except as the sender of the email itself), phone number, location, contacts, or any media files.

1.5 Subscription and Purchase Data

To process subscriptions and provide premium features, UpTakes uses the native subscription mechanisms built into each platform:

iOS: Subscriptions are processed by Apple using StoreKit 2. Apple manages all payment processing, receipt validation, and subscription state. We do not transmit your purchase information to any third party — your subscription data stays between you and Apple.

Android: Subscriptions are processed by Google through Google Play Billing. Purchase tokens are sent to our backend running on Cloudflare Workers, which verifies them against Google’s Play Developer API. The Cloudflare backend receives only the purchase token, your subscription state, and a randomly generated identifier. It does not receive your Google account, name, email, or payment information.

1.6 Marketing Attribution

UpTakes uses AppsFlyer (https://www.appsflyer.com/legal/privacy-policy/) to measure how users discover the app and which marketing efforts work. AppsFlyer collects an advertising identifier and install source data on both iOS and Android.

iOS specifically: We also use the Meta (Facebook) SDK to measure the effectiveness of advertising campaigns on Meta platforms. The Meta SDK collects an advertising identifier and app event data.

You control what advertising identifiers are shared:

  • iOS: When you first launch UpTakes, you’ll see Apple’s App Tracking Transparency prompt. If you choose “Ask App Not to Track,” AppsFlyer and Meta will not receive your advertising identifier. You can change this anytime in Settings → Privacy & Security → Tracking.
  • Android: You can opt out of advertising identifiers in Google Play services settings under Settings → Google → Ads → “Delete advertising ID.”

2. What We Do Not Collect

To be explicit, we do not collect:

  • Your photos or videos (existing or newly recorded)
  • Your name, email address, phone number, or mailing address (except as voluntarily included in a support email)
  • Your physical location or GPS data
  • Your contacts, messages, calendar, or browsing history
  • Biometric data (face/fingerprint scans, voice recordings outside of recordings you initiate)
  • Information from other apps on your device

We do not build advertising profiles about you, and we do not sell your data.


3. How We Use What We Collect

The data described in Section 1 is used only to:

  • Provide and operate the app (process recordings, manage subscriptions, deliver premium features)
  • Diagnose problems you’ve reported via support emails
  • Understand which features are used most so we can prioritize improvements
  • Measure marketing campaign effectiveness so we can find more users like you
  • Comply with legal obligations

We do not use your data to build personal advertising profiles, and we do not sell your data to third parties under any circumstances.


4. Who We Share Data With

We share data only with:

We may also share data when legally required (court order, lawful subpoena), to protect our rights or the rights and safety of others, or as part of a business transition (acquisition, merger). We will notify users of any business transition that would change how data is handled.


5. Data Retention

  • Videos: Kept on your device until you delete them. We never have a copy.
  • Usage events on your device: Kept on your device until you uninstall the app or clear app data.
  • Diagnostic logs you email us: Kept in our support inbox until manually purged. We aim to delete these within 90 days of resolving the related issue.
  • Subscription state: Kept by Apple, Google, and Cloudflare for the duration of your subscription and as required by applicable accounting and tax law (typically 7 years).
  • Marketing attribution data: Retained by AppsFlyer and Meta per their respective privacy policies, typically 1 to 2 years.

You can request deletion of any data we hold by contacting info@uptakes.app.


6. Security

Within UpTakes, we implement specific security measures:

  • Diagnostic logs sent via “Email UpTakes” are encrypted with AES-256-GCM before leaving your device.
  • The Cloudflare backend authenticates Google Play Developer API requests using a service account credential, not user credentials.
  • Subscription tokens are transmitted over TLS (HTTPS) to our backend.

No system is perfectly secure. If we discover a security incident affecting your data, we will notify you and the appropriate authorities within the timeframes required by applicable law.


7. Children’s Privacy

UpTakes is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has used our app and we may hold data about them, contact info@uptakes.app and we will delete the data promptly.


8. Your Rights

Depending on where you live, you have the right to:

  • Access — Get a copy of the data we hold about you
  • Correction — Have inaccurate data corrected
  • Deletion — Have your data deleted (“right to be forgotten”)
  • Restriction — Limit how we process your data
  • Objection — Object to specific uses of your data
  • Portability — Receive your data in a portable format

European Economic Area / UK residents: You have these rights under GDPR. Our lawful basis for processing usage data is legitimate interest (operating and improving the app); for marketing data, your consent (which you can withdraw via the iOS App Tracking Transparency prompt or Android advertising ID settings).

California residents: You have these rights under CCPA. We do not “sell” personal information as defined by CCPA.

To exercise any right above, email info@uptakes.app from the email address associated with your inquiry. We respond within 30 days.


9. International Data Transfers

UpTakes is operated from the United States. If you use the app from outside the U.S., your data may be transferred to and processed in the U.S. or in any country where our service providers operate. For data transferred from the European Economic Area, UK, or Switzerland to the U.S., we rely on standard contractual clauses or other lawful transfer mechanisms.


10. Changes to This Policy

We may update this Privacy Policy as the app evolves or as legal requirements change. When we make material changes, we will:

  • Update the “Last Updated” date at the top
  • Post the revised policy at https://uptakes.app/privacy-policy/
  • For significant changes, notify you in the app or via the email address associated with your support inquiry

Your continued use of UpTakes after changes are posted means you accept the updated policy.


11. Compliance

UpTakes is designed to comply with:

  • Apple App Store Review Guidelines and Apple’s privacy standards
  • Google Play Developer Program Policies
  • General Data Protection Regulation (GDPR) for European users
  • California Consumer Privacy Act (CCPA) for California residents
  • Children’s Online Privacy Protection Act (COPPA) for minors
