App: UpTakes Video Camera (the “App”)
1. Acceptance of Terms
By downloading, installing, or using the App or website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our App or services.
2. Use of the App
You may use the App solely for lawful personal or business purposes. You agree not to:

All content, code, logos, trademarks, and media within the App or website are owned by UpTakes or its licensors. You receive a limited, non-transferable, revocable license to use the App and its features. No other rights are granted.
6. User Content
If you upload, record, or share videos through the App:
- You retain ownership of your content.
- You grant UpTakes a limited license to host, process, and display your content solely to operate and improve the App.
- You are responsible for ensuring you have all necessary rights to any uploaded material.
7. Analytics and Third-Party Services
The App uses analytics and SDK tools (including the Facebook SDK for iOS) to measure engagement and optimize performance. These services may collect anonymous or aggregated data as described in our Privacy Policy.
8. Disclaimers and Limitation of Liability
The App is provided “as is” and “as available.”
We make no warranties of any kind, express or implied.
To the fullest extent permitted by law, UpTakes is not liable for any indirect, incidental, or consequential damages arising from your use of the App or website.
9. Termination
We may modify, suspend, or terminate the App or your access at any time, without notice, for any reason, including misuse or legal compliance requirements.
10. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles. Any dispute shall be resolved in Utah County courts.
