1. Acceptance of Terms

By downloading, installing, or using the App or website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our App or services.

2. Use of the App

You may use the App solely for lawful personal or business purposes. You agree not to:

Reverse-engineer, decompile, copy, or distribute the App’s software or media
Use the App to violate any law, regulation, or third-party right
Interfere with the App’s performance or attempt unauthorized access to our systems
Use the App to record any person without their knowledge or consent in jurisdictions where such consent is required

We reserve the right to suspend or terminate access for violations.

3. Accounts and Access

UpTakes does not require you to create an account with us. Subscription status is managed through your Apple ID (iOS) or Google Account (Android). You are responsible for maintaining the security of those accounts and for all activity associated with them.

4. Purchases and Subscriptions

The App offers a free trial and optional subscription plans:

Free trial: 30 days of full access, followed by 3 free recording days
Monthly subscription: $1.99/month, auto-renews monthly
Annual subscription: $9.99/year, auto-renews annually

Pricing may vary by region or change over time. The current price will be shown to you before purchase.

4.1 iOS Subscriptions

On iOS, payments are processed through Apple’s App Store. Subscriptions automatically renew unless canceled in your Apple ID account settings at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

To manage or cancel an iOS subscription, go to Settings → [Your Name] → Subscriptions on your device, or visit your Apple ID account settings on the App Store.

4.2 Android Subscriptions

On Android, payments are processed through Google Play. Subscriptions automatically renew unless canceled in your Google Play account settings at least 24 hours before the end of the current billing period. Your Google Play payment method will be charged for renewal within 24 hours prior to the end of the current period.

To manage or cancel an Android subscription, open the Google Play Store app, tap your profile icon, then Payments & subscriptions → Subscriptions.

4.3 Refunds

All charges are processed by Apple or Google. Refund requests are handled directly by the platform that processed your payment:

iOS: Submit a refund request at https://reportaproblem.apple.com
Android: Submit a refund request through the Google Play Store under Payments & subscriptions → Budget & order history

UpTakes Video LLC does not directly process or issue refunds. Apple’s and Google’s refund policies apply, in addition to any consumer protection rights you may have under applicable law.

5. Intellectual Property

All content, code, logos, trademarks, and media within the App or website are owned by UpTakes Video LLC or its licensors. The App’s gesture-controlled recording technology is protected by U.S. patent. You receive a limited, non-transferable, revocable license to use the App and its features. No other rights are granted.

6. User Content

Videos recorded using the App are stored locally on your device and in your photo library. UpTakes does not upload, host, or store your videos on any server. You retain full ownership of all content you create. You are responsible for ensuring you have all necessary rights to any content you record or share, including obtaining consent from any individuals who appear in your recordings where required by law.

7. Analytics and Third-Party Services

The App uses the following third-party services to measure engagement and optimize performance:

AppsFlyer — install attribution and analytics (iOS and Android)
Meta / Facebook SDK — advertising measurement and app event tracking (iOS only)
Cloudflare Workers — subscription verification backend (Android only)

Subscriptions are processed natively through Apple’s StoreKit (iOS) and Google Play Billing (Android). UpTakes Video LLC does not directly receive your payment information.

These services may collect device identifiers and usage data as described in our Privacy Policy.

8. App Store and Google Play Acknowledgments

8.1 Apple App Store Users

You acknowledge that these Terms are between you and UpTakes Video LLC, not with Apple Inc. Apple has no obligation to provide any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

8.2 Google Play Users

You acknowledge that these Terms are between you and UpTakes Video LLC, not with Google. Google has no obligation to provide any maintenance or support for the App. Your use of the App must comply with Google Play’s Terms of Service in addition to these Terms.

9. Disclaimers and Limitation of Liability

The App is provided “as is” and “as available.” We make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, UpTakes Video LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App or website, including but not limited to loss of data, lost profits, lost recordings, or interruption of service.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you in full.

10. Indemnification

You agree to indemnify and hold harmless UpTakes Video LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may modify, suspend, or terminate the App or your access at any time, without notice, for any reason, including misuse or legal compliance requirements. Upon termination, your license to use the App is immediately revoked. Sections 5, 6, 9, 10, and 12 survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be resolved in the courts located in Pinellas County, Florida.

13. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. For material changes, we will provide notice through the App or website. Continued use of the App after changes constitutes acceptance of the updated Terms.
